Terms of Use and Sale
Aussie Collectibles · Last updated 24 October 2026
These terms govern your use of the Aussie Collectibles app and website. By creating an account you agree to them. If you do not agree, do not use the marketplace.
1. What Aussie Collectibles is
Aussie Collectibles is a marketplace that connects buyers and sellers of collectible items in Australia. We are not the seller. Every item is sold by the individual or business that listed it, and the contract of sale is between that seller and the buyer. Our role is to provide the platform and to process payment between the two.
2. Eligibility
- You must be at least 18 years old and resident in Australia.
- You must give accurate account details and keep them up to date.
- You are responsible for anything done through your account. Keep your login secure.
3. Selling
Your listing
- You must own the item, or be authorised to sell it, and be able to deliver it.
- Describe items honestly. Condition, faults, missing parts, reproductions and repairs must be disclosed.
- Photos must be of the actual item you are selling.
- Set a price that includes everything the buyer must pay other than any stated postage.
Intellectual property
You may sell genuine second-hand collectibles, but you may not use another party's trade marks, logos, artwork or copyrighted images in your listing text or photos beyond what is necessary to identify the item you are selling. Counterfeit, bootleg and unauthorised reproduction items are prohibited, and listings that infringe someone's rights will be removed.
Prohibited items
You may not list counterfeit goods, stolen goods, weapons, hazardous materials, adult material, recalled products, anything illegal to sell in Australia, or anything we reasonably consider unsuitable for a collectibles marketplace.
Getting paid
- Seller payments are handled by Stripe. You must complete Stripe's onboarding and identity verification before you can be paid.
- Funds for a sale are held until the item is confirmed delivered, or until tracking shows delivery, and are then released to you in line with Stripe's payout schedule, less any platform fee disclosed to you at the time of listing. We may hold funds for longer where a problem has been raised, where an order is under review, or for your first few sales on the marketplace.
- Providing valid tracking is what releases your payment. An order sent without tracking may be held until the buyer confirms receipt.
- You are responsible for your own tax obligations, including GST if you are registered.
Sending the item
You must dispatch a sold item promptly — within 3 business days unless the listing says otherwise — and provide tracking where available. Risk in the item passes to the buyer on delivery.
4. Buying
- Placing an order is an offer to buy from the seller. The contract forms when the seller accepts and dispatches the item.
- Payment is taken at the time of purchase through Stripe.
- Read the listing carefully. Collectibles are often second-hand and sold as described rather than as new.
5. Your rights under Australian Consumer Law
Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Competition and Consumer Act 2010 (Cth), including the Australian Consumer Law. Where a seller is acting in trade or commerce, the consumer guarantees — that goods match their description, are of acceptable quality and are fit for purpose — apply to that sale and cannot be contracted out of.
If an item is not as described, is faulty, or never arrives, contact the seller first through the app. If that does not resolve it, contact us at admin@aussiecollectibles.com.au and we will help mediate.
6. Returns, refunds and disputes
- Not as described, faulty, or not delivered: the buyer is entitled to a remedy from the seller — repair, replacement or refund depending on the failure.
- Change of mind: sellers are not required to accept change-of-mind returns unless their listing says they do.
- Raise a problem within 7 days of the expected delivery date, using Report a problem on the order or by emailing us. If an item doesn't arrive, or is significantly not as described, the buyer gets a full refund; where it is not as described, the buyer returns it and the seller pays the return postage.
- Where a dispute is not resolved between the parties, we may reverse a payment, hold funds, or refund the buyer, acting reasonably on the evidence available.
Card chargebacks
A chargeback is where a buyer's bank reverses a card payment. Because payments on Aussie Collectibles are collected by us, a chargeback is taken from us in the first instance, together with a fee charged by the card network.
- Where a chargeback arises from a seller's listing, order or conduct — including an item not sent, not as described, or sent without usable tracking — that seller is responsible for the amount charged back and any associated fee.
- We may recover that amount by deducting it from funds we hold for you, from your future payouts, or by invoicing you directly. We will tell you when we do this and why.
- You agree to give us, promptly and on request, the evidence needed to defend a chargeback — tracking numbers, proof of postage, photographs and message history.
- Where a chargeback results from fraud against the marketplace rather than anything the seller did wrong, we bear it.
- Repeated chargebacks may lead to payouts being held, listings being removed, or an account being closed.
Nothing in this section limits a buyer's rights under the Australian Consumer Law, or a seller's right to dispute a deduction with us.
7. Fees
Any platform fee, and the payment processing fee charged by Stripe, are disclosed to sellers before a listing goes live. We will give at least 30 days' notice in the app before changing our fees.
8. Our role and limits
- We do not inspect, authenticate, own or take possession of listed items.
- We may remove listings, suspend accounts or refuse service where these terms are breached, or where we reasonably suspect fraud or illegality.
- We aim to keep the marketplace available but do not guarantee uninterrupted access.
- To the extent permitted by law, and subject to section 5, our liability to you for any claim connected with the marketplace is limited to the fees we received on the transaction the claim relates to.
9. Your content
You keep ownership of the listing text and photos you upload. You grant us a non-exclusive licence to display, reproduce and promote that content in connection with running and marketing the marketplace. You confirm you have the right to grant that licence.
10. Privacy
Personal information is handled in accordance with our Privacy Policy.
11. Changes and governing law
We may update these terms; we will post the updated version here and notify you in the app if the change is significant. Continuing to use the marketplace after that means you accept the change. These terms are governed by the laws of Australia, and the courts of Australia have jurisdiction over any dispute.
